1. Agreement
By accessing or using PayComply ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and PayComply.
2. Service Description
PayComply provides software tools to help organizations assess and improve their compliance with the EU Pay Transparency Directive (2023/970). The Service includes:
- Readiness assessment questionnaire
- Compensation data analysis and pay gap identification
- AI-powered job classification
- Compliance reporting (PDF)
3. Important Disclaimer
PayComply is not a law firm and does not provide legal advice. Our tools provide data-driven analysis to support your compliance efforts. The output should be reviewed by qualified legal and HR professionals before making employment decisions. We do not guarantee legal compliance.
4. User Responsibilities
- You must have authorization to upload employee compensation data
- You are responsible for the accuracy of uploaded data
- You must comply with applicable data protection laws (GDPR) when handling employee data
- You must not upload data for malicious purposes or to harm individuals
- You are responsible for keeping your account credentials secure
5. Data Processing
Uploaded compensation data is processed in real-time and is not permanently stored on our servers. See our Privacy Policy for full details on data handling.
6. Payment
- Free tier: readiness assessment quiz and sample data analysis
- Paid tiers: one-time payment processed securely via Stripe
- Prices are in EUR and exclude applicable VAT
- 14-day money-back guarantee if you have not downloaded an analysis report
- Professional tier includes 3 re-analyses and the full compliance toolkit; additional analyses may be purchased separately
7. Intellectual Property
The Service, including its design, code, and methodology, is owned by PayComply. Your uploaded data remains yours. Analysis results generated from your data are licensed to you for your internal business use.
8. Limitation of Liability
To the maximum extent permitted by law, PayComply shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We may modify or discontinue features with reasonable notice. Scheduled maintenance will be communicated in advance.
10. Termination
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days unless legally required to retain it.
11. Governing Law
These terms are governed by Swedish law. Any disputes shall be resolved by the courts of Stockholm, Sweden.
12. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect.
